Documents required in order to give notice of marriage in Jersey

 

Everyone

1. Copies of both parties' FULL Birth Certificates (note: the "short" version is NOT acceptable).
2. Every document in a language other than English must be accompanied by an officially certified translation into the English language.
 

People who have been married previously

1. Documentary proof of freedom to marry must be provided by any party who has been previously married. A widow must produce her marriage certificate as well as her late husband's death certificate. A widower, however, need only produce his late wife's death certificate.
2. A divorced person must produce a Court sealed and certified copy of the Decree Absolute or Final Decree. Note: a decree nisi is NOT acceptable.
 

Minors wishing to marry

  If you have attained the age of sixteen years but are under the age of twenty years, you must obtain the written consent of your parents, who are living, or of your guardian before the Superintendent Registrar's Licence to Marry can be issued. If your parent(s) or guardian live in Jersey, this consent must be given in the presence of the Superintendent Registrar. If your parent(s) or guardian live outside the Island, their consent must be given on a form, which will be provided for this purpose by the Superintendent Registrar on request. Where parents are no longer living, proof must be provided.
 

People who have changed their names

  The deed poll, statutory declaration or other similar official document, confirming a formal change of name, must be provided.
 

Non British persons wishing to marry

  All parties giving notice of a marriage, between persons other than
British Citizens are advised that there may be laws in their own country which, if not observed, might render the marriage null and void in that country. In this connection, the advice of the Consul or Consular Agent for the country in question should be sought. In addition non British citizens, travelling to Jersey for the purpose of marriage, may well require the issue of an emigration entry clearance, prior to travelling from abroad. Please be sure that any such permit does not prohibit marriage in countries other than your own. In any event, such persons are advised to make contact with the Chief Inspector of Immigration, Albert Pier, St Helier, Jersey JE2 3NE, well in advance of seeking entry so that their case may be examined.

 

Recognition of foreign divorces

The validity of overseas divorce is only recognised in Jersey in certain circumstances.

These are as follows:

1. if, at the date of the institution of the proceedings in the country in which it was obtained, either spouse was habitually resident there; or
2. where the law of that country uses domicile as a ground of jurisdiction in matters of divorce, either spouse was domiciled in that country, or
3. where either spouse was a national of the country in which the divorce was granted; or
4. if the divorce is recognised as valid in the country of the spouses domicile.

Note: The terms "brother" and "sister" include brother and sister of the half blood.
The term "husband" and "wife" include former husband and wife.
The above prohibitions apply to illegitimate as well as to the legitimate relationships.
